Oct. 16-Two teenage brothers sentenced Thursday for severely beating
a Hutchinson man last year were described as good students who acted out
of character.
Reno County District Judge Tim Chambers sentenced 19-year-old
Romero Cotton to 38 months in prison for beating Earl M. Iverson, 45, on
Aug. 17, 2008, at a home in the 700 block of North Plum Street.
Cotton’s younger brother, 15-year-old Ja’Mon, was sentenced by
District Judge Joe McCarville to one year of Community Corrections, an
intensive form of probation, along with four weekends in a local youth
shelter.
Both pleaded guilty in August to a single count of aggravated
battery for beating Iverson, who suffered several fractured facial bones
and other injuries in the assault.
Romero Cotton faced a presumptive prison sentence of three to 14
years for the crime, while Ja’Mon faced a possible sentence of up to
three years in a juvenile correctional facility.
The brothers will also be responsible for more than $60,000 in
restitution, which includes Iverson’s extensive medical bills.
Iverson on Thursday asked both judges for justice, while his
cousin Tara Iverson read a letter on his sister’s behalf, requesting the
“unprovoked, premeditated” actions not go unpunished.
The letter described Iverson as “being left for dead,” and family
members flying to the Wichita hospital from out of state because they
believed it would be the last time they might see Iverson alive.
“A simple apology goes a long way … it’s hard to forgive
individuals who have no remorse,” the letter stated.
Parents, friends and family members of the Cottons testified under
oath during Thursday’s hearing that the actions of both boys that day
were out of character, and they had never been in trouble before.
Both Romero and Ja’Mon apologized to Iverson and his family on
Thursday.
Cindy Cotton testified both her sons were remorseful. She said her
25-year marriage to the boys’ father, James, was ending at the time of
the incident, but the boys hoped their parents would reunite.
When the boys found their mother with Iverson that night, “what
they walked into was devastating,” she said, because they were not aware
of the relationship.
“There were a lot of other issues other than what happened that
night,” she said. “They walked into something, and they already had
other emotions built up.
“It was not premeditated, it was not for (Iverson). They just saw
someone else with their mom.”
Attorney Greg Bell, representing Romero, noted the youth is on a
football scholarship at Hutchinson Community College after wrestling for
the University of Nebraska last year.
Numerous others testified Thursday to his character, including
Hutchinson High School athletic director Eric Armstrong; Allen Fee of
Fee Insurance Group, a longtime family friend; and Rion Rhoades,
football coach at Hutchinson Community College.
“I think he made a mistake that night,” Fee said. “I don’t think
he’s a threat to society whatsoever.”
Bell requested Romero receive a year’s probation, citing his young
age, his efforts to be rehabilitated through counseling, his bright
future, and that he “suffered a mental impairment” at the time of the
beating that affected his judgment.
Jan Rogers, a local mental health counselor, testified she began
counseling Romero this summer, following counseling he received at the
University of Nebraska. She testified she believed Romero suffered from
“fight-or-flight syndrome” when he found Iverson “intruding in his
family system.” She said Romero wanted to protect Ja’Mon that night from
learning of his mother’s affair but was unable to.
Romero described how he had gone to his mother’s home to get a DVD
that night and was surprised when he found Iverson in his mother’s
bedroom.
“I thought everything was getting better and (our family) could go
back to the way we used to be,” he said. “I had no idea who this man was
or what he was doing there.
“I just lost it. I’d never been in a fight before. It was like it
wasn’t me. If there was any moment I could take the harm I did to
(Iverson) or his family, I would take it back.”
Romero said he has learned to control himself, to prevent
something similar from happening again.
Iverson’s wife and daughter, however, testified to the pain their
family had endured.
Autumn Iverson, 16, testified she couldn’t recognize her father in
the hospital because he’d been beaten so badly. She feared he wouldn’t
watch her graduate or walk down the aisle, because both his eye sockets
were shattered.
Susan Iverson recalled watching “bloody tears rolling down his
swollen, bloody face” in the hospital. She said a bloody 2-by-4 was
found next to Iverson at the scene that he had been beaten with, and
tread marks from shoes were on the side of his body.
“(Romero) should not be able to go to school, play football and
hang out with his friends every day as if he did not commit a felony
…” she said, adding it was “unbelievable HCC coaches want to win so
bad they will allow a convicted felon to play football.”
She said it made her sick hearing on the radio how great a person
Romero was while knowing he almost beat her husband to death.
“Everyone is confronted with crisis situations in life,” Chambers
told Romero. “It does not give you the ability to beat someone so much
so that they’re lucky to be alive.”
Despite positive testimony from Romero’s local supporters,
Chambers said, the bottom line is sentencing guidelines indicate a
presumptive prison sentence for aggravated battery, and in this case a
man had been kicked and beaten with a 2-by-4.
“Perhaps a higher power intervened to make sure (Iverson) is here
today,” he said. “No doubt this is a tragic situation that will continue
for many years.”

    The sentence is light in my opinion. It wasn’t like it was a just a few punches. The intent was obviously to do much harm.

    Even if you snap, everyone has to be accountable for their actions. The circumstances were tough emotionally for them but it is in times like those that you must exhibit some judgement and not act like an animal.

    Hopefully, 3 years in prison will make him think about the consequences of such actions in the future. For society, it should be a realization to all that just because you may snap in an instance, that does not allow such animal behavior.

    this is a kid who has never been in trouble in his life and u have the wife of a cheating man asking that these kids go to jail for what ? so she can get back at this women for cheating with her husband ? hell the guy who was the victim never said anything not a word .now that doesnt excuse these kids conduct by any means and they should be punished ,but u send a kid to prison and then ask him to pay 60000 in restution after he has serve the sentence damn what kind of chance does he have to go forward to level this situtation out cause his education stops for three years so were does he get the oppurtunity to go foward to make this right ?exactly anthor black man that the system will have for a long time and a pat on back for a judge who will be on the bench until he retires or die which ever comes frist

    It’s my understanding that the brothers beat the guy to a pulp with a 2×4 and left him for dead so I think they should have gotten more time! I also think that they probably ought to throw the brother’s home wrecker mama AND the “victim,” who happens to be married man with kids, in prison for a while too!

    People need to think twice before engaging in adulterous affairs such as this as we can see the consequences are hardly never worth those few minutes of bliss!

    A very sad story for all involved. Romero is a young man who made a mistake. A very bad one done in the passion of the moment. He, like so many kids, had hoped his parents, who were going through a divorce, would one day be reunited. He was faced, with the most extreme example, that that was not going to be the case and he went off. Again, not justifing it, but please don’t throw all your stones until you have walked in another’s shoes. Once again – A VERY, VERY SAD STORY.

    For those of us who were able to watch this young man grow, and become a fierce wrestler, also saw what that did to him. He was unstoppable and was told to be that way, faced with a similar situation any child would snap and attack the man with his mother, BUT, Cotton was not a simple child…he had the ability and the willingness to kill that man that is why the sentence is what it is. No difference than a boxer charged with attempted murder for getting into a fight…Romero was a 4 time state champion and #1 in the nation for wrestling, with that ability more time building his character NOT his muscle wouuld have saved that young man…It is bad for all and wish him and his brother the best in getting out this situation and becoming better men.

    I’m appalled at the outcome of all of this. The system did not work.

    I actually know what happened that night. Yes, these boys did beat up this man. The beating happened because Mr. Iverson was drunk and mouthed off when the boys showed up. He was going to take them both on. He was sitting up and beligerent at the hospital. Theiy had no intention of beating this man to death.

    Should they serve some time? YES. Neither one had a record and Romero was a college student. Give him a month in jail and lots of probabtion.

    How many celebrities killed poeple while driving drunk and got away with it? Vince Neil, Rebecca Gayheart, Halle Berry.

    The judge must be up for re-election. He had to take a stand against an athlete. He made a mess of this situation.

    And as for Mr. Iverson’s family – geez they sure overlooked his bad behavior didn’t they. If marriage is a legal contract then he himself broke the law when he committed adultery. The daughter’s grandstanding is a joke. She’s no “daddy’s girl.”

    At least the Cotton boys told the truth and acted maturely in the courtroom. Its too bad we can’t say the same about the Iversons.

    Disbelief – Unbelievable. I’ve had belligerent, drunk people want to take me on. So what? Did I take a 2×4 to the guy? Absolutely not. And why? Because I knew there would be consequences for doing something so heinous, and there would be no point in it. I also was a child of divorce several times over. I knew that my parents breaking up was a failure in their marriage that had nothing to do with me. I was sad, but there would be no way I would jeopardize my future for their failure. Iverson wasn’t the lone participant in the adultery. Did they consider beating the crap out of their mother too? Don’t think so. Did she share the same amount of blame in what they walked in on? Even more than Iverson did. It was at her house wasn’t it?

    I also heard one of his eyes was hanging out. If that isn’t a sign of how badly beaten this man was, that what is? So, he was sitting up in the hospital… what does that mean? they should only get a month in jail? If he would have been able to only push up on one elbow, would that have meant a 3 month sentence was in order? And only when he could not feed himself and had to be on a ventilator, would it be considered then that a 3 year sentence is in order?

That’s a perfect example right there. 3 years is not enough for attempted murder. He should not be eligible for parole until he is at least 30. I’ve met the man once, and maybe I caught him on a bad day, but he was the rudest person I’ve ever met. He was the perfect example of a thug on that day. Now I sure don’t know the story, but from what I’ve read, I think he’s getting off very, very lucky. And it’s sad that we still have people in this world, blacks especially, that still try to pull the racism card.

    Here’s the problem, Justice? — There are negative news stories, and I’d like to think that as rational and logical people, that there would be discourse, debate, without it turning into name-calling and such.
    Is there racism in this country? My God, yes. I see it all the time. Many never will.
    Was this a case of it? I have no idea. You can look at this case and you can have your opinions. What I see is so many lives just ruined. That’s the sad part.

    You are right Justice, no one said they were in because they were black, and yes you are right if it had been white kids it might’ve been different, but the Cottons are not poor, they are middle-class, they are good people who spent many hours raising their children! Things just went wrong, and somewhere that love and guidance was lost and now the boys have to pay for their mother and fathers sins! Please stop, because my heart goes out to the parents right now, who don’t want to drag out this horrible moment in their lives, a time when things just weren’t going right!. At some point I am praying that these young men can turn this around, and the parents can find some comfort… To Romero and Ja’mal, to you I wish the best as can be, and I will pray for your protection. To Justice/Lou : nobody wins here, and the Cotton family has lost :(

    I believe he shouldn’t of used a weapon in the fight but what else was he supposed to do when he walked in with a man in his mother’s bed? You have to put in work on someone that is not welcomed in your home ESPECIALLY having sex with your mom. I do not condone his actions but I can not say I can’t see where he is coming from. I also noticed that the man was married? That wife is a weirdo for still being with him eventhough he is with another woman. Hope everything gets better and this small moment in this man’s life does not ruin the other moments. Good day.

    In my opinion, the sentencing was just and fair. I understand the vicitim may never completely recover from his injuries. Still punishment must be served, regardless of ethnicity. This has evolved into a slight fiasco, much like the Limbaugh thing and the Rams. Nobody, and i mean nobody plays for the owners, they perform for the money $$$$$$$$$$, bottom line. Contrary to what the overblown media would have you believe.

    The punishment sounds about right to me. I am no legal expert, but from what I have read that has been reported, they are very lucky the guy survived and kept them from being locked away for good.

    The whole situation needs prayer, lots of it.

    AGAIN – Many, many, MANY people are out there driving drunk and killing people – and getting no jail time. These people were not provoked into escalating a violent exchange. They just chose to start their cars and run people down.

    I’ll be the second person, gladly, here to tell you to grow up.

    That brings up a good question, who’s responsibility was it to make sure the door was locked and the boys didn’t walk in on mom and her lover? I believe it was mom’s house so you would think the fault would lie with her.
